TCMA Media Service --- Technology Policy, Terms, & Conditions
Preamble & Scope
This Technology Policy, Terms & Conditions document applies to all Media Services offered by the Tassajara Creek Maintenance Association (TCMA) to its members.

Definitions
- Board Member: Any HOA Member who has been elected or appointed to the TCMA Board of Directors.
- Governing Documents: Collectively, the following documents (a) Codes, Covenants, & Restrictions (Declaration; CCRs); (b) Bylaws; (c) Articles of Incorporation; (d) Rules & Polices of the HOA.
- HOA: The Tassajara Creek Maintenance Association (TCMA).
- Management Team or Personnel: Any (a) TCMA Board Member; (b) vendor or individual hired by TCMA to perform property management.
- Media Service; Service: Any website; social media account, page, or group; messaging platform; etc., provided, created, maintained, or otherwise operated by TCMA.
- Member: Any title deed holder of a lot specified in the CCRs to be part of the TCMA membership.
- TCMA: The Tassajara Creek Maintenance Association.
- Technology Policy; Terms & Conditions: This document.
- User: Any person who has an account on any TCMA Media Service.
Privacy statement - all services
TCMA policy dictates that Member information is never published or otherwise posted to any TCMA Media Service. Any information found to violate this policy will be removed immediately upon discovery and TCMA will investigate the matter for possible further action. Also see the Definition of Inappropriate Content section below.
Access Requirements
Access to this Media Service is open to TCMA Members and select Management Personnel only. Accounts for more than one person in the same household are permitted as long as each account holder is on title for the lot in question. Multiple accounts per person, per service, are not allowed. Access will be denied for any of the following reasons:
- The requester is not on title to a member lot as defined in the TCMA CCRs. This includes requests from non-owner residents, renters, former owners, guests, relatives, the general public, etc.
- The requester is not a member of the TCMA Management Team.
- The requester previously had access to a TCMA Media Service but that access was revoked.
- Refusal to acknowledge and follow this Policy.
Terms of Use - All Media Services
When using any TCMA Media Service, You agree as follows:
- To use the Service as intended - i.e. as an informational resource regarding TCMA's operations.
- To comply with all terms, conditions, and\or policies that govern the use of any TCMA Media Service.
- To comply with all terms, conditions, and\or policies of any 3rd party used to deliver any TCMA Media Service (i.e. Facebook, Twitter, etc).
- To not disclose personal information about any person regardless if that person is or is not a TCMA Member.
- To not download, acquire, or use any TCMA asset except as permitted by TCMA.
- To not post inappropriate content (defined below) on any TCMA Media Service.
- To not use the Media Service for any commercial activity such as the solicitation or selling of goods or services.
- To not engage in "trolling", spamming, or similar activity.
- To not harass users of any TCMA Media Service.
- To not hack, or otherwise circumvent, any security measure installed by, or at the direction of, TCMA.
- To not perform any activity that is illegal under the laws of the State of California or the Federal government of the United States.
Violation of the above will result in immediate suspension and possible revocation of access to TCMA Media Services.
TCMA is not responsible for any action taken by 3rd parties for violations of their terms, conditions, and\or polices.
Content Posting
When posting content to any TCMA Media Service, You agree as follows:
- You are the author of the posted content or have obtained permission from the copyright holder to use and post the content
- The content complies with this and all other TCMA Media Service policies.
- TCMA may use the content for any reason without fee, compensation, permission, or additional waiver.
- To assume any and all liability resulting from posting the content.
- To indemnify and hold harmless TCMA against any claims and\or injury resulting from the posting of the content.
- Content found in violation of this, or any other applicable policy, may be removed immediately without advance notice.
- Failure to comply with any provision of this section shall be cause for immediate suspension and possible revocation of Your access to the Media Service.
Definition of Inappropriate Content
TCMA has a zero-tolerance policy regarding the posting of inappropriate content on its Media Services. Content that involves any of the following topics will be removed without warning:
- Profanity
- Racism, misandry, misogyny, or other hateful content
- Violence
- Any content involving persons who appear to be under 18 years of age
- Nudity or content of an erotic nature
- Pornography (including hentai) or bestiality
- Illicit substances
- Weapons and related subtopics (use, care, holsters, making of, etc.) regardless of legality
- Illegal activity (CA state and Federal laws)
- Ad hominem and\or targeted statements of an abusive, inflammatory, or threatening nature
- "Doxing" or the release of other private information such as ID, health, financial, address, location, etc.
- Links to any site or service that contains anything listed above
- The above applies to content in all formats including, but not limited to: pictures, videos, animation & cartoons (i.e. anime, manga), etc.
When content from the above list is discovered on a TCMA Media Service, TCMA will (a) quarantine the content; (b) suspend the offending account; and (c) investigate the circumstances surrounding the posting of the content. If TCMA finds the content was posted with malicious intent, the offending party will be banned permanently from all TCMA Media Services.
The above list is not exhaustive and it will be updated periodically to conform with applicable laws and the needs of TCMA.
Disclaimer Regarding Information Accuracy; Release of Liability
While every effort is made to ensure the accuracy of content published on TCMA Media Services, errors do occur and TCMA will promptly remove inaccurate information upon discovery. Statements contained herein are intended to be informational only and TCMA is not liable for any injury or damage resulting from inaccurate information contained on the Service. Please refer to TCMA's published Governing Documents, the Davis-Stirling Act, California Civil & Corporations Code, and other relevant law for an authoritative reference on TCMA operations.
Duty to Protect Account
All TCMA Media Service accounts are intended to be used solely by the Member to whom the account is issued. In addition, You are liable for all actions performed via Your account and it is Your responsibility to safeguard your account credentials. Finally, it is imperative that You notify TCMA immediately upon learning of a possible breach of your account credentials.
Conflict between Media Services, Governing Documents & Applicable Law
If any statement on any TCMA Media Service is found to be in conflict with TCMA's Governing Documents or California law, the latter shall control. Please contact the TCMA Board representative with any questions.
Revisions
TCMA may, at its discretion, revise the terms and conditions of this Policy without advance notice. When Policy revisions are published, You are required to review and acknowledge the revisions in order to retain access to the Service. Failure to acknowledge any Policy may result in account suspension or revocation.
